Terms of service

These Terms of Service (“Terms”) govern your use of the Black Girls Have Always Been Magic online store and your purchase of products offered through it.
By accessing the Store or completing a purchase, you agree to these Terms. If you do not agree, do not use the Store or purchase its products.
STORE OPERATOR
The Store is operated by Black Girls Have Always Been Magic and Martha Faye Ikner. The Store is hosted through Shopify, which provides the ecommerce platform used to offer products and services.
ELIGIBILITY
You must be legally capable of entering a binding agreement in your jurisdiction to complete a purchase. You agree to provide current, complete, and accurate information during checkout.
PRODUCT INFORMATION
We make reasonable efforts to describe products accurately. Colors and appearance may vary depending on the device or screen used.
Images of products labeled “Coming Soon,” “Concept,” “Prototype,” or “Mockup” are provided to illustrate products in development. They do not guarantee final materials, dimensions, packaging, pricing, features, or availability.
The Truth Bank™ is currently in development and is not available for purchase unless its product page expressly states otherwise.
DIGITAL PRODUCTS
Digital products are delivered electronically. No physical product will be shipped when a listing identifies the product as a digital download.
Customers are responsible for using a compatible device and application, providing an accurate email address, downloading all included assets, and saving purchased files securely.
PURCHASES AND PAYMENT
Prices are displayed in the currency identified during checkout. Applicable taxes may be added where required.
You authorize the payment provider to charge the payment method submitted at checkout. We may cancel or refuse an order when reasonably necessary because of suspected fraud, pricing errors, technical problems, legal restrictions, or policy violations.
PERSONAL-USE LICENSE
A digital-product purchase grants the original purchaser a limited, nonexclusive, nontransferable, revocable license for individual, personal use.
The purchase does not transfer ownership of the product’s written content, designs, trademarks, branding, copyright, or other intellectual property.
PROHIBITED USE
You may not:
• Copy, share, forward, resell, redistribute, sublicense, or upload a purchased file
• Remove or alter copyright or ownership notices
• Represent our content as your own
• Create a competing or derivative product using our materials
• Use an individual-license product for a class, workshop, coaching program, ministry, organization, membership, or commercial purpose
• Attempt to interfere with the Store’s operation or security
• Use the Store for fraudulent, unlawful, abusive, or harmful activity
Group or organizational use requires prior written authorization or an appropriate license.
INTELLECTUAL PROPERTY
The Store and its original content; including written materials, product names, designs, graphics, photographs, branding, downloads, and related materials; are owned by or licensed to Black Girls Have Always Been Magic and are protected by applicable intellectual-property laws.
“Black Girls Have Always Been Magic,” “The Truth Bank,” and associated branding may not be used in a manner that suggests sponsorship, ownership, endorsement, or affiliation without written permission.
THIRD-PARTY SERVICES AND LINKS
The Store may use or link to third-party services, including Shopify, payment processors, social platforms, and other providers. Their services are governed by their own terms and privacy practices.
We are not responsible for third-party websites or services that we do not control.
REFUNDS
Purchases are subject to our Return and Refund Policy, which is incorporated into these Terms.
DISCLAIMERS
Our products provide faith-centered personal-reflection and organizational tools. They are not medical, mental-health, legal, financial, tax, or other professional advice and are not a substitute for services from a qualified professional.
Individual experiences and results vary. We do not guarantee a particular personal, spiritual, financial, health, or business outcome.
To the extent permitted by law, the Store and its content are provided on an “as available” basis without warranties not expressly stated in these Terms.
LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Black Girls Have Always Been Magic and its owner will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Store or its products.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
INDEMNIFICATION
To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the Store, violation of these Terms, or infringement of another party’s rights.
SEVERABILITY
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
GOVERNING LAW
These Terms are governed by applicable United States federal law and the laws of the State of Illinois, without regard to conflict-of-law principles, except where consumer-protection law requires otherwise.
CHANGES
We may update these Terms to reflect changes in the Store, products, services, or legal requirements. The revised effective date will appear at the top.
